There is no “right of private action” for an employee regarding DOT regulations.  Before filing any such action, the employee should contact ODAPC with the employees claim or complaint and request a review.  For example: Specimen Validity Testing (SVT) rules regarding dilute specimens were changed by DOT pursuant to such ODAPC review.
